Terms of Service

Overview Moikas LLC ("we," "us," or "our") operates moikas.com (the "Site"). By accessing or using the Site, or by placing an order, you agree to be bound by these Terms of Service ("Terms"), including all policies referenced herein (such as our Shipping Policy, Refund Policy, and Privacy Policy).

These Terms apply to all users of the Site, including browsers, customers, and contributors of content. If you do not agree to these Terms, you may not access the Site or use any of our services.

We reserve the right to update these Terms at any time by posting changes on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. It is your responsibility to review this page periodically.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell our products to you.

Section 1 – Eligibility & General Use You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or place an order. You may not use the Site or our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including copyright or trademark laws). You must not transmit viruses, malware, or any destructive code. A breach of these Terms may result in immediate termination of your access to the Site and services.

Section 2 – Orders & Products All products are sold on a made-to-order basis:

• In-house 3D printed items are custom produced specifically for your order.
• Merchandise (apparel, mugs, etc.) is produced on demand by our trusted print partner (Printify).
• Select items (such as coffee-themed merchandise) are available via subscription with recurring billing.

Due to the custom/on-demand nature of all products, orders are final upon placement (see our Refund Policy for details on damage/defect claims). We currently ship only within the United States (including Alaska, Hawaii, Puerto Rico, and APO/FPO addresses). International orders are not accepted. Prices are subject to change without notice. We reserve the right to modify, limit, or discontinue any product or service at any time.

Section 3 – Accuracy of Information We strive to display product images, colors, descriptions, and pricing accurately, but we cannot guarantee that your device will display them perfectly. Information on the Site is provided for general purposes only and may contain errors or outdated details. We reserve the right to correct errors and update information without prior notice (including after an order is placed).

Section 4 – Billing & Account Information You agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse or cancel any order at our discretion (e.g., suspected fraud, reseller activity, or pricing errors). We will attempt to notify you if an order is canceled.

Section 5 – Third-Party Services & Links Certain features (e.g., Printify fulfillment, payment processors) are provided by third parties. We are not responsible for their performance or policies. Links to third-party sites are provided for convenience only — we are not liable for their content or your transactions with them.

Section 6 – User Content & Submissions Any comments, feedback, ideas, or submissions you send us become our property. We may use, edit, or publish them without compensation or obligation to you. You are solely responsible for your content and agree it will not violate third-party rights or contain unlawful/objectionable material.

Section 7 – Personal Information Your personal information is governed by our Privacy Policy.

Section 8 – Prohibited Uses You may not use the Site to: harass, defame, discriminate, infringe IP rights, submit false information, upload malware, spam, or interfere with Site security/functionality. We reserve the right to terminate access for violations.

Section 9 – Disclaimer of Warranties & Limitation of Liability The Site and products are provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or that products will meet your expectations. To the fullest extent permitted by law, Moikas LLC and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or products.

Section 10 – Indemnification You agree to indemnify and hold harmless Moikas LLC and its affiliates from any claims arising from your breach of these Terms or violation of laws.

Section 11 – Governing Law These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles.

Section 12 – Severability & Entire Agreement If any provision is deemed unenforceable, the remainder remains in effect. These Terms (and referenced policies) constitute the entire agreement between us.
